Open Letter to The Attorney General of the United States of America

According to the information supplied by the International Press, on August 9, 2005, the Court of Appeals of the Eleventh Circuit Court of Atlanta declared null and void the decision passed in Miami which had condemned Gerardo Hernández Nordelo, René González Sehwerert, Ramón Labañino Salazar, Antonio Guerrero Rodríguez and Fernando González Llort for infiltrating the extremist Cuban American groups in the south of Florida in order to obtain information about terrorist activities directed against Cuba. Their prison sentences have already been declared illegal by the Working Group on Arbitrary Detentions of the Human Rights Commission of the
United Nations.

For the past seven years, these five young men have been held in maximum security prisons; they have been held incommunicado in isolated cells for long periods of time and two of them have been denied the right to receive family visits.

At this present time, considering the nullification of the sentence, nothing justifies their incarceration. This arbitrary situation which is extremely painful for them and their families, cannot be allowed to continue. We, who have signed below, are demanding their immediate liberation.

Como se ha informado en la prensa internacional, el pasado 9 de agosto la Corte de Apelaciones del Onceno Circuito de Atlanta declaró nulo el juicio celebrado en Miami, donde se condenó a Gerardo Hernández Nordelo, René González Sehwerert, Ramón Labañino Salazar, Antonio Guerrero Rodríguez y Fernando González Llort, quienes se habían infiltrado en los grupos extremistas cubano-americanos del sur de la Florida para obtener información sobre la actividad terrorista contra Cuba. Su encarcelamiento ya había sido declarado ilegal por el Grupo de Trabajo sobre Detenciones Arbitrarias de la Comisión de Derechos Humanos de las Naciones Unidas.

Desde hace siete años, estos cinco jóvenes permanecen en cárceles de máxima seguridad; han sufrido incomunicación en celdas de castigo por largos períodos y a dos de ellos se les ha privado del derecho a recibir visitas de sus familiares.

Ahora, después de la anulación del juicio, nada justifica que permanezcan en prisión. Esta arbitraria situación, tan dolorosa para ellos y sus familias, no puede prolongarse. Los abajo firmantes reclamamos su inmediata liberación.
